Assisting Individuals with Disabilities to Register to Vote

Nebraska Revised Statute §32‐310 requires Nebraska VR provide the opportunity to individuals with a disability to register to vote. This opportunity must be offered at the time an individual:

  • Applies for services 
  • Participates in an annual review 
  • Notifies VR of an address change.

To register to vote in Nebraska, an individual must:

  • Be a United States citizen;
  • Be at least 18 years of age on or before the first Tuesday after the first Monday in November;
  • Live in the State of Nebraska;
  • Have not been convicted of a felony, or if convicted, at least two years have passed since the completion of the sentence for the felony including any parole term; and
  • Have not been found by a court to be mentally incompetent.

Staff who help individuals complete the Nebraska Voter Registration Application are prohibited from:

  • Seeking to influence an individual's political preference or party registration;
  • Displaying any such political preference or party allegiance;
  • Making any statement or taking any action to discourage the individual from registering to vote; or
  • Making any statement or taking any action to lead the individual to believe a decision to register or not to register has any bearing on the availability of services or benefits.

Any information on whether an applicant registers or declines to register will be confidential and will only be used for voter registration purposes.

1. If the individual would like to register or re-register to vote, on the application, during the annual review or notifies Nebraska VR of an address change, staff must provide the individual the following options to register to vote:

  • Nebraska Voter Registration Application attached to this chapter and available in the office to fill out or take with them 
  • Nebraska Voter Registration Application attached to this chapter and available in the office mailed or emailed
  • Nebraska Secretary of State's online registration: https://www.nebraska.gov/apps-sos-voter-registration/

Provide a copy of the Voter Registration Disclaimer when mailing/emailing a Nebraska Voter Registration Application.

QE2 will ask during the Application, Annual review or if “Address Line 1” changes:

  •  Did the applicant request assistance to register to vote? Yes or No
  • If yes: How did you provide assistance?
    • Provided a copy of the voter application
    • Mailed/Emailed the voter application
    • Filled out voter application in the office
    • Provided link to the Secretary of State's online registration

NOTE: If YES or NO is not checked on the application, please follow up to obtain a YES or NO. Should the individual decline, you must still offer a copy of the Voter Registration Application and/or the Secretary of State's website.

If registering for the first time, the individual must provide a copy of the following:

  • Current and valid photo ID showing the same name and residence address provided on the Nebraska Voter Registration Application, or
  • A copy of a utility bill, bank statement, government check, paycheck or other government document which is dated 60 days immediately prior to the date of presentation showing the same name and residence address provided on the Nebraska Voter Registration Application.

2. Provide assistance as needed to the individual in completing the Nebraska Voter Registration Application and submitting the completed and signed application to the appropriate Election Commissioner or County Clerk.

  • If the individual assumes responsibility for submitting the Nebraska Voter Registration Application the individual should mail or deliver the application to the Election Commissioner or County Clerk of the county the individual resides in.
  • If the individual provides the application and identity/residence copy to VR to submit, the application must be submitted no later than 10 days from the date of receipt to the Election Commissioner or County Clerk of the county in which the VR office is located. The Election Commissioner or County Clerk's office will forward if the individual does not reside in the same county as the VR office.
  • If the date of receipt is within 5 days prior to the third Friday preceding any election, the application shall be submitted no later than 5 days from receipt.
  • Enter a task note stating the date the Nebraska Voter Registration Application was mailed/submitted to the Election Commissioner or County Clerk and include if application was completed at the time of, annual review or a change of address.

3. Re-registering is required whenever someone changes;

  • Name
  • Address
  • Political Party Affiliation
