Appointment to Permanent Status 6-Month Probationary Employee

Prior to an employee’s 5th month in the position, the manager/office director will assess the employee’s performance and recommend either Appointment to Permanent Status, Extension of Original Probation or Termination. The performance review and recommendation must occur before the employee reaches his/her 6th month anniversary date.

Appointment to Permanent Status

30 to 45 days prior to the 6th month date, the manager/office director should assess the employee’s performance and launch the Probationary Performance Review. If the employee has met the performance expectations given the amount of time in the position, complete the performance review and inform the employee prior to the 6th month anniversary date that you are recommending appointment to permanent status. Download and attach a pdf copy of the performance review to an email addressed to the VR HR Program Director recommending appointment to permanent status.

The VR HR Program Director will prepare the recommendation for the Director. Upon approval of this recommendation, the Director will send a letter notifying the employee of his/her appointment to permanent status, and will also notify the NDE Human Resources (HR) office of the appointment to permanent status.

The appointment to permanent status will become effective six months after the employee’s start date.

Employees who have had excessive absences may have his/her probationary period extended by the equivalent amount of time absent in order for the manager to have sufficient opportunities to observe the employee’s performance.

Extension of Original Probation

If the manager/office director determines that the employee has not met the performance expectations, the manager/office director will discuss his/her findings with the VR Director so a determination can be made regarding an extension of the probation.

If extension of probation is decided upon, the manager will draft an Action Plan to define expectations, remedial activities and expected dates of achievement. The Action Plan shall be developed and approved in consultation with the Legal Council’s Office, NDE HR and the VR HR Program Director.

Once approved, the manager/office director will complete the employee’s Probationary Performance Review and share the Action Plan with the employee prior to the employee’s 6th month anniversary date. Upon completing the Probationary Performance Review, the manager/office director will send an email addressed to the VR HR Program Director recommending the extension. The VR HR Program Director will present the extension of probation recommendation to the Director for formal approval. A letter will be sent to the employee formally notifying him/her of the extension and duration. NDE HR will also be formally notified.

Termination

If a decision is made to terminate the employee during original probation after consultation with the Director of VR, NDE Legal Council and NDE HR will be contacted to begin the termination process.
