Assisting Individuals with Disabilities to Register to Vote

Voter Registration Opportunity (Nebraska Revised Statute 32-310)

Nebraska VR is required to provide individuals with disabilities the opportunity to register to vote at the following times in the VR Process:

  • When applying for services
  • During an IPE Annual Review
  • When notifying Nebraska VR of an address change

Eligibility to Register to Vote in Nebraska

An individual must:

  • Be a U.S. citizen
  • Be at least 18 years old on or before the first Tuesday after the first Monday in November
  • Reside in Nebraska
  • Not have a felony conviction, or if convicted, must have completed the sentence including parole
  • Not have been declared mentally incompetent by a court

Staff Conduct During Voter Registration

Staff assisting with voter registration must NOT;

  • Influence an individual's political preference or party registration
  • Display political preference or party allegiance
  • Discourage the individual from registering to vote
  • Suggest that registering or not registering affects Nebraska VR services or benefits

Confidentiality

Information about whether an individual registers or declines to register is confidential and used only for voter registration purposes.

Step 1: Provide Voter Registration Disclaimer (Forms also attached to this chapter)

Give the individual a copy of:

Step 2: Offer Registration Options

If the individual wants to register or re-register during:

  • Application
  • IPE Annual Review
  • Address change notification

Provide these options:

Step 3: Document in QE2

  • QE2 will ask:
    • Did the applicant request assistance? Yes/No
    • If Yes, record how assistance was provided:
      • Copy of voter application 
      • Mailed/emailed application
      • Completed in office
      • Provided online link
    • If Yes/No is missing on the application, follow up with the client to obtain the answer
    • If declined, still offer application and/or online link.

Step 4: Verify ID for First-Time Registration

Individual must provide:

  • Photo ID with matching name and address, OR
  • Document dated within 60 days (utility bill, bank statement, government check, paycheck, or other government document) with matching name and address).

Step 5: Assist with Submission

  • If individual submits themselves:
    • Mail/deliver to Election Commissioner or County Clerk of their county.
  • If VR submits:
    • Send within 10 days of receipt to local Election Commissioner or County Clerk
    • If received within 5 days before the third Friday before an election, submit within 5 days.
  • Record in task note:
    • Date mailed/submitted
    • Context (application, annual review, address change)

Step 6: Re-Registration Requirements

Re-register if:

  • Name changes
  • Address changes
  • Political party affiliation changes
